1. Definitions

In these Terms and Conditions, "Solace," "we," "us," or "our" refers to Solace, an elderly care home operating at 7 Queenstown Road, Singapore 149050. "Service" refers to all care services we provide, including Seaside Residential Living, Comfort Care Stay, and the Mindfulness & Wellbeing Programme. "User," "you," or "your" refers to any individual accessing our website or engaging our services. "Agreement" refers to these Terms and Conditions together with any service-specific contracts signed between you and Solace. "Content" refers to all text, images, and other material published on our website.

2. Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services. You must be at least 18 years of age to use this website or to enter into a service agreement with Solace. By engaging our services on behalf of another person, you confirm that you have the legal authority to do so.

3. Service Description

Solace provides elderly care services in Singapore, including full-time residential care, short-term comfort stays, and a daytime wellbeing programme. Service descriptions on our website are provided for general information. Specific terms, including scope, duration, and pricing, are set out in the individual service agreement signed prior to commencement of care. Availability of services may vary and is subject to capacity at our facility.

4. User Responsibilities

When using our website, you agree to provide accurate and complete information in any forms you submit; to use the website only for lawful purposes related to enquiring about or engaging our services; not to attempt to disrupt or interfere with the functioning of our website; and not to reproduce, distribute, or modify any content from our website without our written permission.

When engaging our care services, families and authorised representatives agree to provide accurate health and personal information about the resident; to notify us promptly of any changes in the resident's health or circumstances; to comply with our facility policies, including visiting guidelines; and to ensure timely payment of fees as agreed.

5. Intellectual Property

All content on the Solace website — including text, images, logos, design elements, and layout — is the property of Solace or its licensors and is protected by intellectual property laws. You are granted a personal, non-transferable licence to view and use our website for informational purposes. You may not copy, reproduce, distribute, or create derivative works from our website content without prior written consent.

6. Payment Terms

Fees for our services are stated in Singapore Dollars (SGD) and are set out in the service agreement signed by both parties. Seaside Residential Living is billed monthly. Comfort Care Stay is billed weekly. The Mindfulness & Wellbeing Programme is billed monthly. Payment is due within 14 days of invoice unless otherwise agreed. We accept bank transfer and PayNow. Late payments may be subject to a reminder notice, followed by a late payment charge of 1.5% per month if unresolved after 30 days.

7. Refund Policy

Refund requests are assessed on a case-by-case basis. For Residential Living, if notice to leave is given at least 30 days in advance, any pre-paid fees for the unused period will be refunded. For Comfort Care Stay, refunds for early departure are available for full weeks not yet commenced. For the Wellbeing Programme, refunds are available for months not yet commenced. Administrative fees may apply. Please contact us to discuss your specific circumstances.

8. Care Service Terms

Our care services are provided in accordance with standards set by Singapore's Ministry of Health. While we strive to provide the best possible care, we cannot predict specific health outcomes for any individual. Care plans are developed in consultation with families and may be adjusted based on the resident's evolving needs. We coordinate with external medical professionals but are not a substitute for hospital or specialist medical treatment. Decisions regarding medical interventions remain with the resident's authorised family member and their physician.

9. Disclaimers

The information on our website is provided for general informational purposes and does not constitute medical advice. While we endeavour to keep website content accurate and current, we make no representations or warranties about the completeness or accuracy of the information provided. Our services are provided with reasonable care and skill, but we do not warrant specific outcomes. We are not liable for circumstances beyond our reasonable control, including natural disasters, pandemic-related restrictions, or public health emergencies.

10. Limitation of Liability

To the fullest extent permitted by Singapore law, Solace shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim related to our services shall not exceed the total fees paid by you in the six months preceding the event giving rise to the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Singapore law.

11. Indemnification

You agree to indemnify and hold harmless Solace, its directors, employees, and agents from any claims, losses, or damages arising from your breach of these terms, your misuse of our website, or any inaccurate information you have provided to us in connection with our services.

12. Termination

Either party may terminate a service agreement by providing 30 days' written notice. Solace reserves the right to terminate services with shorter notice if circumstances require it for the safety or wellbeing of a resident or other persons at our facility. Upon termination, any outstanding fees remain payable, and we will assist with a reasonable transition period for the resident.

13. Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of Singapore. In the event of any dispute, both parties agree to attempt to resolve the matter through good-faith discussion. If a resolution cannot be reached, the dispute shall be submitted to mediation through the Singapore Mediation Centre. If mediation is unsuccessful, the dispute may be referred to the courts of Singapore.

14. General Provisions

These terms constitute the entire agreement between you and Solace regarding the use of our website. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision shall not constitute a waiver of that provision. Solace may not assign these terms without prior notice. Any notices required under these terms should be sent to the contact details provided below.

15. Changes to These Terms

We may revise these Terms and Conditions from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services following any changes constitutes acceptance of the revised terms. We encourage you to review this page periodically.
